1 Definitions and interpretation
The following terms shall have the following meanings for the purposes of these terms:
“Bespoke Goods” means Goods prepared to an express order of the Buyer.
“Buyer” means the person, firm or company, making a request to designed for you for goods, services, both or either.
“Contract” means the contract consisting of these terms and your order and concluded by either the Buyer clicking “I Agree” on this Site or designed for you starting work on the Goods.
“designed for you” means the design business of Jess Wanless operating from 32 Victoria Street, Morecambe, Lancashire, LA4 4AJ.
“Goods” means the article or articles which the Buyer agrees to purchase from designed for you (and includes Bespoke Goods) or where relevant services provided by designed for you.
“Rights” means all copyright, design rights (whether registered or unregistered) patents, rights in trade marks (whether registered or unregistered), database rights or other intellectual property rights in the Goods for the full term of those rights, worldwide.
2 Price
The Price of the Goods shall be the price stipulated on the Site current at the date of order.
3 designed for you: obligations
3.1 designed for you will use its reasonable care and skill in the production and supply to the Buyer of the Goods.
3.2 designed for you will use its reasonable skill and care in making sure that the Site is continuously available to you. However, because of the nature of the Internet, designed for you does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and designed for you can make no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties.
3.3 designed for you is continually seeking to improve the Site and services offered. designed for you reserves the right, at its discretion, to make changes to any part of the Site.
4. Specification
4.1 The Goods shall be produced (where Bespoke) and supplied in accordance with the description on the Site and if applicable in accordance with all applicable British Standards which relate specifically to the Goods. Please refer also to paragraph 12 below (limitations).
4.2 The Seller may from time to time make changes in the specification of the Goods which are required to comply with any applicable safety or statutory requirements or which do not materially affect the quality or fitness for purpose of the Goods.
4.3 Any contractual description of the Goods by the Seller relates to the identity of the Goods but only if it relates to a central characteristic of the Goods or to a substantial ingredient in their identity.
5 Delivery
5.1 The Seller delivers the Goods using its own preferred carrier and the delivery charges are set out on the Site. designed for you do not charge you for Goods until they are ready for despatch and only charges postage once in relation to each order. In the case of services provided by designed for you 'ready for despatch' means available for booking.
5.2 designed for you will not be liable for any loss or damage due to the late delivery of Goods.
6 Returns
6.1 All our items are carefully handcrafted, checked, packed with the utmost of care. However if you are not fully satisfied with your purchase you may return it to us unworn, well wrapped in the original packaging, in a re-saleable quality within 7 days after receipt for a refund of the purchase price minus the original postage and handling costs.
6.2 If the item is returned as a result of a descriptive error or poor workmanship on our part we will give a full refund including all the appropriate postage costs.
Please use the appropriate means of postage below as we cannot give refunds on items we do not receive.
UK Orders up to £39 - return via Recorded Signed for - this has no insurance cover for jewellery.
UK Orders over £39 and up to £500 - return via Special Delivery.
Overseas orders return by a secure, insured, airmail delivery service.
6.3 Returning any Goods within our return policy amounts to a cancellation of your order. Legal title in the Goods does not pass to you until after the returns period of 7 days has expired. You will then be deemed to have accepted the Goods. The price (but not postage) will be refunded.
7 Exceptions to Returns
7.1 Except for defects in manufacturing, we are unable to process returns relating to earrings for pierced ears or any other form of intimate body jewellery because of the close contact it has with the body.
7.2 Bespoke Goods are not subject to our returns policy. Your statutory rights are not affected.
8 Title and Copyright
8.1 All the jewellery designs displayed on the pages of designed for you are its sole property. Reproduction of the images, the designs or copies of the designs are strictly prohibited.
8.2 All material including any intellectual property in it displayed on this site belongs to designed for you or its suppliers. Subject to the above, we give you the right, for your own personal non-commercial purposes only to:
- retrieve and display the content of this site on your PC screen
- print individual pages on paper
- or store individual pages in electronic form on, for example but not limited to disk, cd, hardrive, usb storage device.
9 The Client's obligations
Payment
9.1 designed for you reserves the right to accept or reject any Order from a Buyer. Despite designed for you’s best efforts some items on the site may be mispriced. If an item's value is higher than its stated price designed for you will, at its discretion, cancel your order and inform you of the cancellation or contact you for your instructions.
9.2 The prices for goods displayed for sale on the Site are as set out on the Site and are inclusive of VAT. Where additional charges are made for delivery, they are clearly explained.
9.3 Payment is due at time of order. No items will be shipped until payment is received. We use Paypal or Nochex for online card processing. You may also pay by personal cheque in sterling drawn on a UK bank, sending the total payment including shipping costs to:

9.4 We cannot accept your order until you have paid for it in full (including applicable delivery charges). Upon payment, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive an e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.
9.5 No Goods will be sent until payment has cleared. On rare occasions, cheques can be returned as unpaid some time after they have apparently cleared. Should your cheque be returned unpaid, we will email you and request another payment or return of any goods supplied. Failure to comply with this will be treated as theft and may result in legal action being taken.
9.6 All prices are retail and include VAT @ 17.5%. Minimum order value for retail orders is £10 before postage and packing.
Card
9.7 We accept the major Credit and Debit cards. For overseas customers, billing in Sterling will be converted by your credit card company at the prevailing exchange rate.
9.8 Our primary payment method is credit/debit card, which are processed securely either by Paypal (worldwide) or Nochex(UK only).
9.9 Paypal will verify some details during payment, such as your card billing address. You will then be able to pay via Visa, Mastercard, Maestro/ Switch, Visa Delta, Solo, Visa Electron, or American Express. Please note: A debit card with a MasterCard or Visa logo would be considered a credit card.
9.10 Paypal account holders will also have the option to log into their account and pay this way.
9.11 Please note, unless you are a Nochex account holder, the maximum payment you can send is £100.
9.12 designed for you never receives card details submitted online to either Paypal or Nochex, nor do we take your credit card details by telephone so they are not kept on file by us.
Cheques in Sterling drawn on UK banks only
9.13 Dated and signed cheques should be sent to us, made payable to designed for you. Please fill in the exact amount as shown in checkout total.
9.14 Don't forget to write your name, address and your cheque guarantee card number with expiry date on the back of the cheque. We reserve the right to delay despatching an order until a cheque has been cleared by the bank, please also note we will not send an order if the cheque or other card details are not enclosed.
10 Cancellations
10.1 If you wish to cancel your order you can do so by email within 7 days of placing it.
10.2 Please note, if you cancel your order and the goods have been despatched to you/received by you, you will be required to return the Goods under our returns policy.
10.3 We may cancel this contract at any time before the Goods are delivered by giving notice in writing or by email. On giving such notice we will promptly repay to the Buyer any sums paid in respect of the Price. The Seller shall not be liable for any loss or damage whatever arising from such cancellation.
11 Liability
11.1 designed for you is not liable for any indirect loss or expense (including loss of profit) suffered by the Buyer arising out of any contract.
11.2 Magnetic catches and beads must not be worn by those using pacemakers. Where we use magnetic catches this fact will be noted in the jewellery description. At present we do not use magnetic beads, but if we do this will also be noted in the jewellery description.
11.3 Many of the materials we use are individually handmade. The gemstones we use are natural materials and as such subject to natural inclusions and variances in colour and cut, and many of our glass beads are also handcrafted in small quantities and again subject to slight variation. Variations in machine manufactured items are usually considered faults, but the variations above are not faults but the result of individual treatment.
11.4 All products are photographed in full colour, but small variations in colour and size may occur between the beads in a piece of jewellery. Slight colour and size differences can occur between batches of beads. Sizes are approximate. Every effort has been made to ensure descriptions are correct, product descriptions such as 'gold', 'silver', 'copper' etc are subjective colour descriptions and do not relate to the materials. Sterling Silver and 9k gold items will be clearly stated as such.
11.5 Also please note that whilst every effort has been made to closely reproduce the colours of the pieces of jewellery we are limited to how the products are represented in the images displayed on your computer screen.
11.6 The liability of designed for you to the Buyer, whether for any breach of contract or otherwise, shall not in any event exceed the Price and the Seller shall be under no liability for any direct loss and/or expense or indirect loss and/or expense suffered by the Buyer or liability to third parties incurred by the Buyer.
11.7 All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of the Seller or affect the statutory rights of a Buyer dealing as consumer.
Jewellery uses
11.8 Beads may discolour over time; we cannot guarantee they will remain colour-fast indefinitely. Whether an item will lose its colour if put through the wash, used for outdoors projects or similar 'out of the ordinary' uses, we have no way of knowing and cannot guarantee they will remain colour-fast.
11.9 All our pieces are designed to sustain normal light wear. The individual links are generally not soldered so will not sustain unreasonable force.
Safety
11.10 All the jewellery findings we use in our jewellery comply with the EU Nickel Directives. Our jewellery is designed for adults, in size and structure. Please note jewellery contains small parts and is not designed for children to play with. Small parts can present a choking hazard to young children.
12 Force Majeure
Both parties shall be released from their respective obligations in the event of any cause beyond the reasonable control of the parties or either of them
13 Notices
Any notices required to be served by designed for you on the Buyer shall be deemed to be properly served if delivered in person or sent by first class pre-paid post or recorded mail to the addresses specified by either designed for you or the Buyer or, where applicable both, as appropriate on the Booking Form.
14 Assignment
designed for you shall be entitled to assign its rights or obligations or a combination of both under this Agreement.
This Agreement is personal to the Client and may not be assigned or charged by it.
15 Proper law and jurisdiction
This agreement shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England.
Any proceedings arising out of or in connection with this agreement may be brought in any court of competent jurisdiction in England and Wales.
16 Third party rights
A person who is not a party to this agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this agreement.
